Understanding Private Vehicle Hire Legislation and Requirements in Birmingham

When choosing a vehicle to use as a private hire vehicle (PHV) in Birmingham, it's important to know the requirements and legislation that will affect your choice.

It’s good to stay up to date with Birmingham City Council’s PHV requirements, as they have changed within the last few years and will continue to shift as the UK moves toward zero emissions.

As far as the driver goes, there are multiple license conditions to remember. You must notify Birmingham City Council within seven days of any offences or endorsements, inform them of vehicle changes, keep your address up to date and more – all this can be found on the Birmingham City Council website.

Requirements for Private Hire Vehicles in Birmingham

One of the most well-known requirements is that a private hire vehicle must be younger than eight years old from the date of first registration when the license application is submitted. A vehicle older than eight will not be licensed. Imported vehicles are assessed from their original country registration date, so there is no getting around this.

Previously, Birmingham council’s PHV emissions guidelines required diesel vehicles to meet Euro 6 and petrol vehicles to meet Euro 4 emissions. However, the rules tightened from the first of January 2026 - all licensed vehicles are required to be ultra-low emission or zero emission capable as a minimum. There is also a proposal to only grant new licenses to fully electric vehicles from 2030 onwards.

Birmingham City Council has run a large support package to help drivers switch to a compliant vehicle – if you are now due an upgrade to a hybrid or all-electric private hire vehicle, it is definitely worth checking the current grant scheme and seeing what you might qualify for.
 
In terms of the vehicle itself, it doesn’t just need to be low or zero-emission; there are also further complex guidelines for what will be allowed a vehicle license.

- Vehicles must be built to M1 specification, meaning used for the carriage of passengers and comprise no more than eight seats, including the driver.
- The vehicle must be capable of carrying a minimum of four average-sized adults in comfort, be right-hand drive, with no fewer than four road wheels.
- They also need a minimum of four doors giving adequate access and egress; however, they can be saloon, hatchback or estate in body style.
- If you are driving a larger vehicle such as an MPV or minibus and rear row access relies on tip seats, passengers must be able to exit from either side with an independent tip seat operation at both ends of the middle row.

Additionally, there are also specific minimum dimensions that need to be met – your wheelbase must be of at least 2,540mm (100 inches) measured centre-to-centre of the front and rear wheels. For larger vehicles with individual seats rather than bench seats, each passenger needs a minimum of 407mm (16 inches) of seat width.

Of course, seat belts must be fitted for every passenger listed within the vehicle’s capacity.
Some things rule vehicles out completely, including soft-tops, removable hard-tops, and anything modified with aftermarket window tinting.

So, what can I use as a private hire vehicle in Birmingham?

Standard four-door saloons, hatchbacks and estates that meet the wheelbase requirement and emissions regulations are a good fit, with fully-electric vehicles now being the preferred option to stay ahead of regulation changes.

Classic choices such as the hybrid Toyota Corolla and Toyota Prius have long been the dominant choices for a reason – they have low running costs, rear cabin space and are renowned for their reliability.

Other commonly selected models include the Skoda Octavia and Skoda Superb, another brand touted for their high mileage, reliability and lower running costs as a private hire vehicle.
